Parents of Deceased 5-Year-Old Girl Admit to Child Abuse: A Heartbreaking Case

The parents of a 5-year-old girl, found deceased in a Baltimore residence in October 2024, entered guilty pleas to charges of child abuse on Thursday. Gerald Byrd, 36, and Bernice Byrd, 33, were unable to provide authorities with information about the last time they saw their daughter, Zona Byrd, alive. Upon investigation, it was revealed that Zona was grossly malnourished, weighing under 18 pounds at the time of her tragic discovery. Initially, a trial was slated to commence next week, but the couple opted to plead guilty instead.

When law enforcement officials responded to the family’s home in October 2024, they encountered the lifeless body of 5-year-old Zona Byrd. Further investigations discovered the extent of her malnutrition and dire circumstances. “This case is tragic from beginning to end. Two parents now face the possibility of significant prison sentences,” remarked Deborah Levi, the defense attorney, who expressed her perspective on behalf of Gerald Byrd.

Describing Gerald, Levi said, “He’s a quiet and reflective individual. Despite his kindness, he was raised within the system of the Department of Human Services; that influenced his understanding of parenting. He is not inherently a malicious person.”

Both Gerald and Bernice Byrd confessed to first-degree child abuse resulting in their daughter’s death, as well as first-degree child abuse leading to severe physical injuries related to their six-year-old son. Their son was also reported to be malnourished, weighing only 35 pounds.

Levi further commented on the case, stating that the Department of Social Services failed to conduct adequate investigations or respond to previous concerns raised about the family’s welfare. “He didn’t plead to murder; instead, he pled guilty to child abuse, which implies that the actions did not necessarily have to be intentional—there could have simply been recklessness involved in his parenting,” she explained.

As part of the plea deal, the Baltimore City State’s Attorney’s Office has suggested that the parents receive life sentences, with the stipulation of serving 50-70 years before any possibility of parole. In an official statement, Ivan Bates, the State’s Attorney for Baltimore City, remarked, “No punishment could be more severe for these defendants than living with the knowledge that they took the life of their innocent child. Today’s guilty plea also serves to protect Zona’s siblings, who are victims of their parents’ atrocious behavior.”

Both parents are scheduled to return to court for sentencing on June 10.

Gerald and Bernice Byrd have pleaded guilty to first-degree child abuse that resulted in their daughter’s death, as well as first-degree child abuse leading to severe injury concerning their son, who was six years old at that time.

Authorities also discovered that their son was malnourished, weighing only 35 pounds.

Levi pointed out that the Department of Social Services should be held accountable for not properly investigating or addressing prior reports of concern regarding the family.

She noted, “He didn’t plead guilty to murder. His plea was for child abuse, indicating that intent did not have to be a factor. This could have stemmed from a lack of responsible parenting.”

Under the terms of the plea agreement, the Baltimore City State’s Attorney’s Office has recommended that the parents face life in prison, with only 50-70 years served before eligibility for parole.
